Background

The Promotion of Access to Information Act, No 2 of 2000 (PAIA) was enacted giving effect to the constitutional right in terms of Section 32 of the Bill of Rights of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights.

In terms of Section 52 of PAIA, all Private Bodies are required to compile an Information Manual. This PAIA Manual is intended to ensure that Nalete complies with PAIA and to foster a culture of transparency and accountability by giving effect to the right to information.

This PAIA Manual also recognises that upon commencement of the Protection of Personal Information Act 4 of 2013 (POPIA), the appointed Information Officer is responsible to regulate compliance with both PAIA and POPIA.

The Information Officer

The Act prescribes the appointment of an Information Officer for Private Bodies. Nalete has appointed an Information Officer to assess requests for access to information and to oversee required functions in terms of both PAIA and POPIA.

All requests for information in terms of PAIA must be addressed to the Information Officer.

South African Human Rights Commission Guide

The South African Human Rights Commission has compiled a Guide as required in terms of Section 10 of PAIA. The Guide contains information on understanding and how to use the Act and is available in all official languages of South Africa.

Records held by Nalete

Nalete holds the following categories of records:

Personnel records: Personal records provided by personnel, conditions of employment, internal evaluation records, training schedules and material, and correspondence relating to personnel.

Customer-related records: Records provided by customers, records provided by third parties relating to customers, and records generated by Nalete relating to its customers, including transactional records and Platform activity.

Private body records: Financial records, operational records, databases, information technology records, and marketing records.

Internal correspondence: Product records, statutory records, internal policies and procedures, and records held by officials.

Other party records: Records pertaining to contractors, suppliers, service providers and other parties, including financial records, correspondence and contractual records.

Records of a public nature — typically those disclosed on the Nalete website — may be accessed without the need to submit a formal application. Other non-confidential records, such as statutory records maintained at CIPC, may also be accessed without a formal application, but an appointment with the Information Officer will be required.

Where applicable to its operations, Nalete retains records in terms of the following legislation:

Request procedure

To request access to a record held by Nalete, you must:

1. Complete the prescribed Form C (Request for Access to Record of Private Body) and submit it to the Information Officer by email to thatomoloto@gmail.com, or by post or hand delivery to Unit 5, La Mignon, 27 Bradford Street, Highveld, Centurion.

2. Pay the prescribed request fee of R50.00 before further processing of the request.

3. The form must contain sufficient information to identify the record requested and the identity of the requester. The requester must state the nature of the right to be exercised or protected and explain why the record is necessary for that purpose.

4. If a request is made on behalf of another person, proof of authority must be submitted.

5. If an individual is unable to complete the prescribed form because of illiteracy or disability, the request may be made orally.

Nalete will process the request within 30 days of receipt, unless an extension is required. The requester will be advised in writing whether access is granted or denied. If an extension is required, the requester will be notified.

Grounds for refusal

Nalete is entitled to refuse a request for information on the following grounds:

— Mandatory protection of the privacy of a third party who is a natural or juristic person (section 63 of PAIA and POPIA); — Mandatory protection of the commercial information of a third party (section 64), including trade secrets and financial information; — Mandatory protection of confidential information of third parties protected by agreement (section 65); — Mandatory protection of the safety of individuals and the protection of property (section 66); — Mandatory protection of records that are privileged in legal proceedings (section 67); — The commercial activities of Nalete itself, including trade secrets and financial information (section 68); — Research information whose disclosure would place the research at a serious disadvantage (section 69); and — Requests that are clearly frivolous or vexatious, or which involve an unreasonable diversion of resources.

If access is refused, the requester may, within 30 days of notification of the decision, apply to a Court for relief. Nalete does not have an internal appeal procedure — the decision of the Information Officer is final.

Remedies when access is refused

Internal remedies: Nalete does not have an internal appeal procedure. The decision made by the Information Officer is final. Requesters will have to exercise external remedies if the request is refused.

External remedies: A requester who is dissatisfied with the Information Officer's decision may, within 30 days of notification of the decision, apply to the Constitutional Court, the High Court, or a Magistrate's Court designated by the Minister of Justice for relief.

Request fee (payable by all requesters except personal requesters): R50.00, payable before the request is further processed.

A deposit equal to one-third of the applicable access fee is payable where the Information Officer is of the opinion that preparation of the required record will take more than 6 hours. All fees are subject to change as allowed for in PAIA.

Availability and updating of this manual

This PAIA Manual is made available in terms of Regulation Number R.187 of 15 February 2002. Nalete will update this PAIA Manual at such intervals as may be deemed necessary.
